These Terms of Service govern your use of motorbayusa.com and any purchase you make from Motor Bay USA ("we", "our", "us"). By using this website or placing an order, you agree to these terms.

1. The parties

Motor Bay USA is located at 161 SE 12 Street, Pompano Beach, Florida 33060, United States. Contact: support@motorbayusa.com.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract in your jurisdiction to purchase from us. By placing an order, you confirm this.

3. Vehicle listings

All vehicles are sold as-is, used, with the condition, mileage, and specifications listed at time of sale. We make every reasonable effort to accurately represent each vehicle. Minor cosmetic imperfections consistent with used condition may not be individually listed but are visible in listing photos.

Prices are in US Dollars and subject to change without notice. A vehicle is only reserved once we confirm your deposit in writing.

4. Payment

We accept payment by credit/debit card and Bitcoin. Payment must clear in full before the vehicle is shipped. We do not offer financing. All transactions are processed securely via encrypted checkout.

5. Titles & registration

All vehicles carry clean titles unless otherwise disclosed in the listing. Title transfer documentation will be provided upon sale completion. You are responsible for registering the vehicle and paying any applicable taxes or fees in your state.

6. Shipping

Shipping terms are detailed in our Shipping Policy. Risk of loss passes to you upon delivery and your signing of the carrier's bill of lading. Any transport damage must be noted on the bill of lading at delivery.

7. Inspection period & returns

Our 10-day inspection policy and 6-month warranty are described in full in our Returns & Warranty Policy, which is incorporated by reference into these terms. All sales are final after the 10-day inspection period expires, except as covered under warranty.

8. Limitation of liability

To the maximum extent permitted by law, Motor Bay USA's liability for any claim arising from a purchase is limited to the purchase price of the vehicle. We are not liable for indirect, incidental, or consequential damages, including loss of use, lost profits, or personal injury resulting from normal off-road vehicle use.

9. Disclaimer of warranties

Except for the express 6-month warranty described in our Returns & Warranty Policy, vehicles are sold "as is." We disclaim all implied warranties, including implied warranty of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

10. Governing law

These terms are governed by the laws of the State of Florida, United States. Any dispute arising from a purchase shall be resolved in the courts of Broward County, Florida.

11. Dispute resolution

Before initiating legal proceedings, you agree to contact us at support@motorbayusa.com and allow us 30 days to resolve the issue in good faith.

12. Changes to these terms

We may update these terms at any time. The current version is always available at motorbayusa.com/terms/. Purchases made after a change are governed by the terms in effect at time of purchase.
